Terms of Service
These Terms of Service govern your use of the FairGo application and website. By creating an account or using FairGo, you agree to these terms. Please read them carefully.
FairGo is operated from Melbourne, Victoria, Australia. In these terms, "FairGo", "we", "us" and "our" refer to the operator of the platform; "you" and "driver" refer to a user of the platform.
1. What FairGo is — and what it is not
FairGo is a job-coordination platform for licensed commercial passenger vehicle (CPV) drivers. It lets drivers pass jobs to one another, place bids, and track a points-based ledger that records the exchange of jobs within the driver community.
FairGo is not a taxi service, transport provider, or booking service for passengers. We do not employ drivers, dispatch passengers, set fares, or carry passengers. We do not own or operate any vehicle. All transport is provided by independent, separately licensed drivers who are solely responsible for their own services, conduct, vehicles, and compliance with the law.
2. Eligibility
To use FairGo you must:
- Be at least 18 years old;
- Hold all current licences, accreditations and registrations required to operate a commercial passenger vehicle in your state (in Victoria, this includes the relevant Safe Transport Victoria accreditation and a valid CPV registration);
- Provide accurate verification information and documents; and
- Comply with these terms and all applicable laws.
You are responsible for keeping your accreditation and registrations current. FairGo verifies documents at sign-up but does not continuously monitor your regulatory status, and verification by FairGo is not a substitute for your own legal compliance.
3. Account verification
New accounts are reviewed by FairGo administrators, normally within 24 hours. We may approve, request more information, or reject an application. We may reject or suspend accounts that provide false information, fail verification, or breach these terms. A rejected applicant may be prevented from re-registering from the same phone number for a period (currently 30 days). Suspended accounts may retain limited read-only and dispute-resolution access only.
4. The Universal Points Engine
FairGo uses a points system to coordinate the exchange of jobs between drivers. You acknowledge and agree that:
- Points are an in-app accounting unit used to coordinate job-sharing among drivers. Points have no monetary value, are not currency, are not redeemable for cash, and cannot be bought, sold, or transferred for money.
- Point movements are recorded in an immutable, append-only ledger that forms the basis of the transparency dashboard and dispute resolution.
- Point rules — including starting balances, weekly resets, loyalty head-starts, no-point-deduction zones, daily free-bid limits, caps, and referral rewards — are set by FairGo and may change over time.
- FairGo may adjust, correct, or reverse point entries where it identifies error, fraud, or abuse.
5. Jobs, bids, and fares
- When you post a job, you are responsible for describing it accurately, including pickup and drop-off, fare, vehicle type, and payment requirements.
- When you win a bid, you commit to performing that job professionally and lawfully.
- The final fare is a matter between you, the passenger, and the applicable fare rules. FairGo does not set, collect, guarantee, or process fares between drivers and passengers.
- Any fare figures shown in the app (including estimates) are indicative only and do not represent a price set by FairGo.
- Disputes about jobs or fares between drivers are recorded in the audit trail; FairGo may assist with resolution using that record but is not obliged to act as an arbiter and is not liable for the outcome of any job.
6. Subscriptions and payments
FairGo offers a free tier and paid subscription tiers. Current pricing and features are shown in the app and may change.
- On iOS, subscriptions are purchased and billed through Apple In-App Purchase; on Android, through Google Play Billing. These purchases are also governed by Apple's or Google's terms, and billing, renewals, and refunds are managed through your app store account.
- Subscriptions renew automatically until cancelled. You can cancel at any time; your paid features remain active until the end of the current billing cycle, after which you revert to the free tier.
- Promotional rates (such as a founder's rate) apply only as described at the time of offer and for the stated period.
- To the extent permitted by law and the relevant app store's policies, payments already made are non-refundable, except where required by the Australian Consumer Law.
7. Driver conduct and safety
You agree to use FairGo honestly and respectfully. You must not:
- Provide false verification information or impersonate another person;
- Manipulate, game, or defraud the points system or referral system;
- Post fake jobs, place bad-faith bids, or misreport final fares;
- Misuse safety features such as the Runner Registry, including filing false reports;
- Harass, threaten, or discriminate against other drivers or passengers; or
- Use FairGo for any unlawful purpose.
Safety features such as runner reports are community-sourced and provided for awareness only. FairGo does not verify the accuracy of every report and is not responsible for actions you take in reliance on them. Always exercise your own judgement and follow the law.
8. Your content
You retain ownership of the content and documents you upload. You grant FairGo a licence to use that content only as needed to operate the platform (for example, displaying job details to relevant drivers, and reviewing verification documents). You are responsible for ensuring you have the right to upload any content you provide.
9. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
10. Disclaimers and limitation of liability
Except for rights that cannot be excluded under the Australian Consumer Law:
- FairGo is provided "as is" and "as available". We do not guarantee the platform will be uninterrupted, error-free, or that jobs, bids, or income will result from your use.
- FairGo is not responsible for the acts, omissions, conduct, or services of any driver or passenger, or for any transport service, fare, or transaction arranged through the platform.
- To the maximum extent permitted by law, FairGo is not liable for any indirect, incidental, or consequential loss, or for loss of income, arising from your use of the platform.
11. Suspension and termination
You may stop using FairGo and close your account at any time. We may suspend or terminate your access if you breach these terms, fail verification, engage in fraud or abuse, or where required by law. Immutable ledger and audit records may be retained after termination as described in our Privacy Policy.
12. Changes to these terms
We may update these terms from time to time. When we make material changes, we will update the "last updated" date and, where appropriate, notify you in the app. Continuing to use FairGo after changes take effect means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Victoria, Australia. You agree to the non-exclusive jurisdiction of the courts of Victoria.
